1. Platform Overview
SEASPIR (operated via seaspir.com) is an intermediary multi-vendor technology marketplace that connects independent sellers with buyers. SEASPIR provides software, hosting, payment routing, escrow tooling, storefront templates, and related platform features that enable sellers to list products and buyers to discover and purchase those products.
Unless expressly stated otherwise in writing, SEASPIR is not the seller of record for products listed by independent merchants. Title to goods, product warranties (if any), and primary fulfillment obligations remain with the selling merchant. SEASPIR does not manufacture, warehouse, or personally inspect every item listed on the platform, and does not guarantee that any particular seller will complete a transaction.
By creating an account, browsing storefronts, placing an order, listing products, or otherwise using SEASPIR, you agree to these Terms, our Privacy Policy, and our Refund, Return & Escrow Dispute Policy. If you do not agree, you must discontinue use of the platform.
2. Eligibility & Accounts
You must be legally capable of entering into a binding contract under the laws of Pakistan (or your place of residence, where applicable) to use SEASPIR. Sellers must complete identity and business verification steps required by SEASPIR, including KYC where applicable, before deploying a live storefront or receiving payouts.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate registration information and keep it up to date. SEASPIR may refuse, suspend, or terminate accounts that provide false information or that we reasonably believe pose a risk to the marketplace, other users, or payment partners.
3. Seller Responsibilities
Independent sellers using SEASPIR agree that they will:
- List only authentic products they are legally entitled to sell, and not offer counterfeit, stolen, prohibited, or restricted goods.
- Provide accurate titles, descriptions, pricing, images, variants, and material disclosures so buyers can make informed purchasing decisions.
- Maintain accurate inventory and promptly update stock levels, fulfillment status, and shipping information.
- Comply with all applicable local, provincial, and national laws, including consumer protection, advertising, tax, import/export, and product-safety requirements.
- Honor confirmed orders in good faith, pack items securely, and communicate promptly with buyers regarding delays or issues.
- Cooperate with SEASPIR escrow, dispute, and compliance reviews, including providing documentation when reasonably requested.
Sellers remain solely responsible for the quality, legality, and safe delivery of their products. Platform fees, escrow holds, COD fee deductions, and payout rules described in SEASPIR seller tools and policies form part of the commercial relationship between the seller and the platform.
4. Buyer Responsibilities
Buyers using SEASPIR agree that they will:
- Place genuine orders with a real intent to purchase, and refrain from fraudulent, abusive, or bad-faith purchase behavior.
- Provide accurate delivery details, contact information, and any special instructions required for successful fulfillment.
- Communicate in a timely and respectful manner with sellers and SEASPIR support when an order requires clarification, rescheduling, or dispute review.
- Inspect delivered goods within the inspection window described in the Refund, Return & Escrow Dispute Policy and submit disputes with supporting evidence when appropriate.
- Pay all amounts due for confirmed orders, including applicable shipping or COD-related charges disclosed at checkout.
5. Orders, Payments & Escrow
Order contracts for goods are formed between the buyer and the relevant seller, subject to SEASPIR platform rules. Online payments may be processed through certified third-party payment partners such as PayFast. For eligible online payments, funds may be held in SEASPIR Escrow according to the timing and dispute rules published in our Refund, Return & Escrow Dispute Policy.
Cash on Delivery (COD) orders, where offered by a seller, follow different settlement mechanics. Platform fees for COD may be deducted from a seller's wallet balance upon delivery confirmation, and negative balances may restrict certain store actions until resolved.
6. Platform Rights
SEASPIR reserves the right, at its sole reasonable discretion, to investigate, limit, suspend, or terminate accounts, listings, storefronts, payouts, or access to any platform feature where we detect or reasonably suspect:
- Fraudulent activities, chargeback abuse, or payment manipulation
- Policy violations, including listing prohibited or misrepresented products
- Suspicious behavior that risks buyers, sellers, payment partners, or SEASPIR
- Harassment, abuse of support channels, or attempts to circumvent security controls
- Legal or regulatory requirements that compel us to restrict access
SEASPIR may remove content, freeze escrow or wallet balances pending review, withhold payouts subject to dispute resolution, and cooperate with law enforcement or payment partners when required. We may also update marketplace features, fees, and policies from time to time; material changes will be reflected on seaspir.com with an updated effective date.
7. Intellectual Property
The SEASPIR name, logos, product names, store templates, software, AI tooling interfaces, visual design system, and related branding are the intellectual property of SEASPIR and its licensors. You may not copy, scrape, reverse engineer, or commercially exploit platform branding or software except as expressly permitted by these Terms or a separate written license.
Product imagery, descriptions, trademarks, and other listing content remain the property of the respective sellers (or their licensors). By uploading content to SEASPIR, a seller grants SEASPIR a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content solely as needed to operate, promote, and improve the marketplace and the seller's storefront.
If you believe content on SEASPIR infringes your rights, contact us with sufficient detail to locate the material and verify your claim. We may remove or disable access to disputed content while we review the notice.
8. AI Features
Certain PRO and PRO+ features may use automated AI assistance for product copy, marketing drafts, accounting summaries, or store operations. AI outputs are assistive only. Sellers remain responsible for reviewing AI-generated content before publishing and for the accuracy of listings, prices, and customer communications.
9. Disclaimers & Limitation of Liability
The platform is provided on an "as available" basis. To the maximum extent permitted by law, SEASPIR disclaims warranties of uninterrupted availability, error-free operation, or fitness for a particular purpose. SEASPIR is not liable for seller product defects, shipping carrier delays outside our control, buyer misuse, or losses arising from a user's failure to follow platform policies.
Where liability cannot be excluded, SEASPIR's aggregate liability arising out of your use of the platform for any claim shall not exceed the greater of (a) the platform fees you paid to SEASPIR in the three months preceding the claim, or (b) PKR 10,000, except in cases of proven fraud or willful misconduct by SEASPIR.
10. Governing Law & Contact
These Terms are governed by the laws of Pakistan. Courts in Pakistan shall have exclusive jurisdiction over disputes arising from these Terms, without prejudice to any mandatory consumer-protection rights that may apply to you.
